Assumption of Risk & Liability Waiver

By purchasing a ticket, attending an event, or entering the Silverbrook Manor property (“Property”), you (“Guest”) agree to the following terms:

1. Assumption of Risk

Silverbrook Manor is a working farm and natural environment. By entering the Property, you acknowledge and voluntarily assume all risks associated with such environments, including but not limited to:

• Uneven ground, mud, gravel, and natural terrain

• Farm equipment, tools, and structures

• Plants, pollen, and environmental allergens

• Insects, including bees, wasps, ticks, and other wildlife

• Weather conditions and outdoor exposure

• Slips, trips, falls, or other physical injury

You understand that these risks are inherent and cannot be eliminated.

2. Food, Beverage & Product Consumption

Guests may be offered tastings, samples, or may purchase food, beverages, or farm products.

• All consumption is at your own risk.

• You are solely responsible for identifying and managing any allergies, sensitivities, or dietary restrictions.

• By consuming any item on-site or purchased from Silverbrook Manor or its partners, you assume all risks related to ingestion, including allergic reactions or illness.

Guests must disclose any severe allergies in advance.

3. Products & Third-Party Goods

Products available for sampling or purchase may include items produced by Silverbrook Manor or third-party partners.

• All products are provided “as is” without warranties of any kind, express or implied.

• Silverbrook Manor is not liable for any adverse reactions, misuse, or outcomes resulting from the use or consumption of any product, whether used on-site or off-site.

• Responsibility for third-party products rests with the original producer; however, by purchasing or using such products, you agree to release Silverbrook Manor from any related claims.

4. Release of Liability

To the fullest extent permitted under New York State law, you hereby release, waive, and discharge Silverbrook Manor, its owners, officers, employees, contractors, affiliates, and partners from any and all claims, liabilities, damages, or expenses arising from:

• Personal injury, illness, allergic reaction, or death

• Property damage or loss

• Participation in any activity on the Property

• Consumption or use of any food, beverage, or product

This includes claims arising from ordinary negligence.

5. Medical Responsibility

You acknowledge that:

• No medical services are provided on-site

• You are responsible for carrying any necessary medications (e.g., EpiPen)

• In the event of an emergency, you authorize staff to seek medical assistance on your behalf at your expense

6. Conduct & Supervision

• Guests must act responsibly and follow all instructions provided by staff

• Children must be supervised at all times

• Silverbrook Manor reserves the right to remove any guest for unsafe or disruptive behavior without refund

7. Photography & Media

By attending, you grant permission for Silverbrook Manor to capture and use photographs or video for marketing and promotional purposes, unless otherwise requested in writing.

8. Indemnification

You agree to indemnify and hold harmless Silverbrook Manor and its affiliates from any claims, damages, or expenses resulting from your actions or negligence while on the Property.

9. Agreement & Acknowledgment

By purchasing a ticket, entering the Property, or participating in any activity, you acknowledge that:

• You have read and understood these Terms & Conditions

• You voluntarily assume all risks

• You agree to this full release of liability
